Terms of Use
The company is being formed. A Swiss company (GmbH) is being set up and will be the party to these terms. On the day it is entered in the commercial register we add its name, address and company number here, and tell you in the app before the change applies.
These terms are an agreement between you and BetterBaby+, Lucerne, Switzerland ("we", "us"), about your use of the BetterBaby+ app ("BetterBaby+"). By creating an account you accept these terms. Our Privacy Policy explains how we handle your data.
1. What BetterBaby+ is
BetterBaby+ helps expecting and new parents follow a pregnancy and a child's early years together. It includes:
- the pregnancy week and general weekly information;
- appointments, checklists, a journal and photos;
- baby names;
- logging feedings, sleep and diapers;
- growth records.
The members of a household share it.
2. Not medical advice, and not a medical device
- General information only. BetterBaby+ does not give medical advice, diagnosis or treatment. Everything in it is general and may not fit your situation: pregnancy weeks, estimated due dates, size comparisons, tips, articles, leaps, milestones and statistics.
- It does not replace your midwife, doctor or pediatrician.
- Not a medical device. BetterBaby+ is not a medical device. It is not intended to diagnose, monitor, predict or treat any condition, and it does not interpret what you record.
- An information tool. BetterBaby+ is not engaged in the practice of medicine. The app is an information tool only, and is not a substitute for the professional judgment of your midwife, doctor or pediatrician.
- Emergencies. Do not use BetterBaby+ in an emergency. If you or your child may need urgent help, call 144 or your doctor.
3. Your account
- Age. You must be at least 18 years old.
- Accurate information. Give accurate information and keep your sign-in details to yourself. You are responsible for what happens in your account.
- Misuse. Tell us at info@betterbaby.ch if you think someone has misused your account.
4. Households and sharing
- A household is shared. Everyone in it can see, add, change and delete what is recorded for its pregnancies and children, including photos.
- Invite only people you trust. Invite codes and links can be forwarded. Anyone with a valid code can join until it expires (after 3 days) or is revoked.
- Admins and members. An admin can remove members, and anyone can leave a household.
- Data about other people. If you record information about another person, such as your partner or your child, you confirm that you are entitled to do so and that you have told any adult concerned.
- If a pregnancy ends. You can remove a pregnancy or a child at any time. Everything recorded for it is deleted, and no more reminders about it are sent.
- When someone leaves. If a member leaves or deletes their account, the pregnancy and child records stay available to the remaining members, because they belong to the family. The Privacy Policy explains the details.
- Followers are not household members. You can add people to look on - a grandparent, a godparent, a friend. They see only the entries someone switches on for them, never health records, and they cannot add, change or delete anything. Nothing is shared with them by default. Following needs the household's approval, and either side can end it at any time. Followers never pay.
5. Your content
- It stays yours. What you add (text, photos, records) remains yours.
- Our limited permission. You give us a limited, non-exclusive permission to store, process and display your content, only to run BetterBaby+ for you and your household. We do not use your content for anything else: not for marketing, not for advertising, and not to train AI models. The permission ends when the content is deleted (backups are kept for up to 30 days).
- What you may not upload: content that is unlawful, that infringes someone else's rights, or that you are not allowed to share.
6. Acceptable use
You agree not to:
- misuse or disrupt the service;
- try to get into other households' data;
- guess invite, follow or referral codes, or abuse promotions;
- reverse engineer the app, except as the law allows;
- use BetterBaby+ for anything unlawful.
7. Subscription, free trial and payment
- A subscription is needed. Each Apple Account gets one free month, on whichever subscription it starts first, monthly or yearly. If you do not cancel at least 24 hours before the free month ends, the paid subscription starts automatically.
- Prices, including VAT: CHF 9.95 a month or CHF 89 a year. The App Store shows the exact price before you buy. BetterBaby+ is offered in the Swiss App Store.
- Billing and canceling. Subscriptions are bought and billed through Apple's App Store. They renew automatically for the same period unless you cancel at least 24 hours before the current period ends. You can manage or cancel them in your Apple Account settings; you keep access until the end of the period you paid for.
- One subscription covers your whole household. Every member can use the paid features on their own device.
- Without an active subscription you can still sign in, export your data and delete your account.
- Price changes. Apple tells you in advance and, where required, asks for your agreement before a new price applies.
- Refunds are handled by Apple under its terms. Deleting your BetterBaby+ account does not cancel an App Store subscription.
8. Founding Families
Founding Families. With the founding code, the first 100 households pay CHF 69 for the first year of the yearly subscription instead of CHF 89. After that it renews at the normal yearly price. The code works until 100 households have used it, or for 3 months after BetterBaby+ is launched in the App Store, whichever comes first.
Invitation rewards are not running. An earlier version of BetterBaby+ gave free days to households that invited each other. That program is switched off, and no free days are granted. If it comes back it will run on Apple's own offer codes, and we will say so here first.
9. Availability and changes to the app
- Availability. We work to keep BetterBaby+ available and your data safe, but we cannot promise uninterrupted or error-free service.
- Changes. We may change or remove features.
- Discontinuing. If we discontinue BetterBaby+, we will give at least 30 days' notice and a way to export your data.
10. Ending your use
- Deleting your account. You can stop using BetterBaby+ and delete your account at any time in Settings → Privacy & data.
- Our right to close accounts. We may suspend or close an account that seriously or repeatedly breaches these terms, after a warning where reasonable.
11. Liability
- Reasonable care, and what we are not liable for. We provide BetterBaby+ with reasonable care. To the extent the law allows, we are not liable for:
- indirect or consequential loss;
- loss of data that could have been avoided by exporting it;
- decisions made on the basis of the general information in the app.
- What these terms do not limit: liability for intent or gross negligence, for personal injury caused by our fault, or for anything else the law does not allow to be limited (Art. 100 of the Swiss Code of Obligations).
12. Apple
If you downloaded BetterBaby+ from the App Store:
- Apple's standard Licensed Application End User License Agreement applies in addition to these terms.
- Apple is not responsible for BetterBaby+ or its content, maintenance or support.
- Apple and its subsidiaries are third-party beneficiaries of these terms.
13. Changes to these terms
- Significant changes: we tell you in the app at least 30 days before they apply.
- If you do not agree: you can delete your account before the changes apply.
- The version and date are shown at the top.
14. Law and jurisdiction
- Swiss law governs these terms, without its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
- Courts: those of Lucerne, Switzerland. If you are a consumer, you can also bring a claim at the courts where you live, and the mandatory consumer protection rules there apply.
15. Support and complaints
- How to reach us. Questions, problems and complaints go to info@betterbaby.ch or Settings → Help & support in the app. One of us reads it and answers, usually the same day and at the latest within one working day.
- Apple. Apple is not responsible for support. Questions about payments and refunds go to Apple.
16. Final provisions
- Severability. If a provision of these terms is invalid, the rest remain valid, and the invalid provision is replaced by one that comes as close as the law allows to what was intended.
- Transfer. We may transfer this agreement to a successor company if BetterBaby+ is sold or merged. We will tell you in advance, and the Privacy Policy continues to protect your data.
- The whole agreement. These terms and the Privacy Policy are the whole agreement between you and us about BetterBaby+.
